Terms of Service

Welcome to DrVirtuel! These Terms of Service ("Terms") govern your use of the DrVirtuel website and the related platform for clinical case simulations (collectively, the "Service"), operated by ILYAS EL GHOR, a sole proprietorship. DrVirtuel is the trade name for a collaborative project developed and maintained by a dedicated team, and for the purposes of these terms, all references to 'we,' 'us,' or 'our' refer to this entity and its project.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Description of Service
DrVirtuel provides a specialized online platform designed to help medical students and general practitioners enhance their clinical consultation skills. The Service offers practical clinical cases in a Multiple-Choice Question (MCQ) format, covering the full scope of a consultation from patient interview to prescription. To create a realistic and engaging training experience, the Service incorporates various multimedia materials, including images, videos, and audio files ("Service Content").
2. Accounts
- Registration: To access the Service, you must register for an account. During registration, we require your first name, last name, and a valid email address. You agree to provide accurate, current, and complete information and to keep this information updated.
- Eligibility: You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account and use the Service.
- Account Security: You are responsible for safeguarding your account password and for any activities that occur under your account. You agree to notify us immediately at drvirtuel@drvirtuel.com of any unauthorized use of your account.
- Account Sharing: Your account is for your individual, personal use only. Sharing your account with others or allowing others to access the Service through your account is strictly prohibited and is grounds for immediate termination of your account without a refund.
3. Subscriptions and Payments
- Subscription Plans: The Service is offered on a subscription basis. Our primary plan is a six-month (semi-annual) subscription that grants full access to all available clinical cases and multimedia content.
- Payments: Payments for subscriptions are processed by our authorized Merchant of Record and reseller, Paddle.com Market Limited or Paddle.com Inc. (collectively 'Paddle'). All purchases are subject to Paddle's Terms and Conditions and Privacy Policy. We do not directly collect or store your full payment card details.
- Manual Payments (Bank Transfer): For users in Morocco, we may offer the option to pay via a direct bank transfer ("virement bancaire"). Activation of accounts paid for manually may take up to 48 hours after we receive proof of payment. We may offer a discount for this payment method.
- Automatic Renewal: Unless you cancel your subscription before the end of your current billing period, your subscription will automatically renew. You authorize Paddle to collect the then-applicable subscription fee for the renewal term.
- Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. The cancellation will take effect at the end of the current billing period, and you will retain access to the Service until that time.
- Price Changes: We reserve the right to change our subscription fees. We will provide you with reasonable prior notice of any price changes. Your continued use of the Service after a price change constitutes your agreement to the new price.
4. Refund Policy
Our policy on refunds is restrictive due to the immediate access to digital content provided upon subscription activation. Please review our full Refund Policy for complete details. Generally, we do not offer refunds, except under very specific circumstances, such as for manual payment users who request a refund before their account has been activated.
5. Intellectual Property and Limited License
- Ownership: All materials within the Service, including but not limited to the clinical cases, text, questions, software, and overall design (the "Service Content"), are the exclusive intellectual property of DrVirtuel and its licensors. The Service and its Content are protected by copyright and other intellectual property laws.
- Limited License: Upon purchasing a subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service Content for your personal, non-commercial, educational purposes for the duration of your subscription.
- Restrictions: This license is strictly conditional on your compliance with these Terms. You are expressly prohibited from:
- Copying, downloading, screen-shotting, reproducing, or distributing any part of the Service Content.
- Modifying, creating derivative works from, or publicly displaying any Service Content.
- Selling, leasing, or otherwise commercializing your access to the Service or its Content.
6. Data Handling and Privacy
We collect and store account information, including your name and email address, to manage your account and provide the Service. We use analytics tools such as Google Analytics and Microsoft Clarity, and may use others like PostHog in the future, to understand how our Service is used and to improve it. 7. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable local, national, or international law.
- Infringe upon our intellectual property rights or the rights of others.
- Attempt to gain unauthorized access to the Service, other user accounts, or our computer systems.
- Interfere with the proper functioning of the Service, including by introducing viruses or other malicious code.
- Scrape, reverse engineer, decompile, or otherwise attempt to discover the source code or underlying structure of the Service.
8. Medical Content Disclaimer
The Service Content is provided for training and educational purposes only. It is intended to simulate clinical scenarios for learning and is not a substitute for professional medical advice, diagnosis, or treatment. You should not rely on the information provided in the Service for real-world medical decision-making. We are not responsible for any errors, omissions, or inaccuracies in the Service Content.
9. Third-Party Services
The Service relies on third-party services to function, including Paddle (payment processing), Vercel (hosting), Supabase (backend and database), Google Analytics, and Microsoft Clarity (analytics). Your use of our Service may also be subject to the terms and policies of these third parties.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DRVIRTUEL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DRVIRTUEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR DATA, RESULTING FROM THE USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including for any breach of these Terms (such as account sharing or content copying). Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on our website or by sending an email to the address associated with your account. Your continued use of the Service after such changes become effective constitutes your agreement to the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law principles.
